Knowledge Horizon India (hereinafter referred to as “the Company”, “we”, “us”, or “our”) is committed to protecting the privacy and security of your personal data. This Privacy Policy explains how we collect, use, disclose, store, and protect information when you access or use our website www.knowledgehorizonindia.com (the “Platform”). This document constitutes a legally binding agreement between you (the “User”) and the Company and must be read in conjunction with our Terms of Use.
By accessing or using the Platform, you acknowledge that you have read, understood, and consent to the practices described in this Policy. If you do not agree, please discontinue use of the Platform immediately.
1.SCOPE AND APPLICABILITY
This Policy applies to:
• All visitors, registered members, subscribers, and users of the Platform.
• Personal data collected via the website, registration forms, newsletters, surveys, and any other touchpoints operated by the Company.
• Data collected through automated means such as cookies, server logs, and analytics tools.
This Policy does not apply to third-party websites, applications, or services linked to or from the Platform. The Company is not responsible for the privacy practices of such third parties and encourages users to review their independent privacy notices.
2. LEGAL BASIS FOR DATA PROCESSING
The Company processes personal data under the following legal bases, as applicable under the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 (“SPDI Rules”) and the Digital Personal Data Protection Act, 2023 (“DPDP Act”) upon its commencement:
- Consent: Where you have given explicit, freely given, specific, informed, and unambiguous consent.
- Contractual Necessity: Where processing is necessary to provide the services, you have requested or to enter into a contract with you.
- Legal Obligation: Where processing is required to comply with applicable Indian law or a court/regulatory order.
- Legitimate Interest: Where the Company has a legitimate interest that is not overridden by your rights and interests (e.g., improving platform security and functionality).
Note: The DPDP Act, 2023 has received Presidential assent and will come into force upon notification. The Company is actively preparing its data processing framework to ensure full compliance upon commencement.
3. PERSONAL DATA WE COLLECT
3.1 Data You Provide Directly
- Identity Data: Full name, username, and profile information.
- Contact Data: Email address, phone number, and postal address.
- Account Credentials: Username and hashed/encrypted passwords.
- Communications: Queries, feedback, and correspondence submitted via the Platform.
- Subscription Preferences: Newsletter and notification opt-in/opt-out choices.
3.2 Data Collected Automatically
- Technical Data: IP address (used solely for diagnostic and security purposes; not linked to your identity), browser type, device type, operating system, and referring URL.
- Usage Data: Pages visited, time spent on pages, links clicked, and navigation paths (aggregated and anonymised).
- Cookie Data: Session identifiers, preference data, and analytics identifiers (see Section 8).
3.3 Sensitive Personal Data or Information (SPDI)
Under Rule 3 of the SPDI Rules, we do NOT ordinarily collect sensitive personal data such as passwords (other than for account authentication, handled via secure one-way hashing), financial information, physical/mental health data, biometric data, or sexual orientation. Should any future service require SPDI collection, we will obtain express written consent, clearly state the purpose, and not retain such data beyond the stated purpose.
4. HOW WE USE YOUR PERSONAL DATA
We use your personal data strictly for the following specified, lawful purposes:
- Service Delivery: To register and maintain your account, provide access to content, and respond to your queries.
- Communications: To send transactional emails (e.g., registration confirmation, password reset) and, with your consent, periodic newsletters, product updates, and educational content relevant to Knowledge Horizon India.
- Platform Improvement: To analyse aggregated and anonymised usage patterns to enhance content, features, and usability.
- Security and Fraud Prevention: To monitor for suspicious activity, enforce our Terms of Use, and protect the safety of users and the Platform.
- Legal Compliance: To meet our obligations under applicable Indian laws, regulatory requirements, court orders, or lawful requests from competent authorities.
- Grievance Redressal: To address complaints or disputes raised by users as required under the IT Act and DPDP Act.
We will not use your personal data for any purpose other than those listed above without your prior consent. You have the right to withdraw consent at any time (see Section 10).
5. DISCLOSURE AND SHARING OF PERSONAL DATA
5.1 No Sale of Personal Data
The Company does not sell, trade, rent, or otherwise transfer your personal data to third parties for commercial purposes under any circumstances.
5.2 Permitted Disclosures
We may share your data in the following limited circumstances:
- Service Providers & Data Processors: Third-party vendors who provide hosting, email delivery, analytics, or technical support services strictly under written data processing agreements that impose confidentiality and security obligations no less protective than this Policy.
- Legal & Regulatory Requirements: Where disclosure is required by law, court order, or a competent Indian governmental authority (e.g., CERT-In, MEITY directives). We will notify you of such disclosures to the extent permitted by law.
- Business Transfers: In the event of a merger, acquisition, or restructuring of the Company, personal data may be transferred to a successor entity, subject to equivalent privacy protections. Users will be notified prior to any such transfer.
- Protection of Rights: Where disclosure is necessary to protect the rights, property, or safety of the Company, its users, or the public.
5.3 Aggregated and Anonymised Data
We may share anonymised, aggregated, non-personally identifiable statistical data with research partners, content creators, and the public for educational or reporting purposes. Such data cannot be used to identify individual users.
6. DATA STORAGE, RETENTION, AND DELETION
6.1 Data Storage Location
All personal data is stored on servers located within India, as required under Section 40 of the DPDP Act, 2023 and applicable sectoral rules. [If cross-border transfer is required in future, the Company will comply with Chapter IV of the DPDP Act and obtain appropriate approvals.]
6.2 Retention Period
We retain personal data only for as long as is necessary to fulfil the purpose for which it was collected, or as required by applicable law:
- Account Data: Retained for the duration of the active account and up to 3 years after account closure or last active use.
- Communication/Subscription Records: Retained for 2 years from the last communication or until opt-out, whichever is earlier.
- Server & Access Logs (IP-based): Retained for 90 days for security diagnostics, then purged.
- Legal Hold Data: Where required for ongoing litigation, regulatory investigation, or statutory obligation, data will be retained until the conclusion of the relevant proceeding.
6.3 Secure Deletion
Upon expiry of the retention period or upon a verified deletion request, personal data will be securely erased or anonymised in accordance with IS/ISO/IEC 27001 standards so that it cannot be reconstructed or identified.
7. DATA SECURITY
The Company implements and maintains reasonable security practices and procedures as mandated by Rule 8 of the SPDI Rules, 2011, including:
- Encryption: All data in transit is protected using TLS 1.2 or higher (HTTPS). Passwords are stored using industry-standard one-way cryptographic hashing (e.g., bcrypt or PBKDF2) and are never stored in plaintext.
- Access Controls: Personal data is accessible only to authorised personnel of Knowledge Horizon India who require such access to perform their duties, subject to the principle of least privilege. Access is governed by role-based permissions.
- Firewall & Network Security: The data infrastructure is protected by enterprise-grade firewalls, intrusion detection systems, and is housed in a secure data centre environment.
- Vulnerability Management: Regular security audits, penetration testing, and patch management procedures are in place.
- Incident Response: The Company maintains a documented Information Security Incident Response Plan. In the event of a data breach that is likely to cause harm to users, we will notify affected users and the relevant authority (CERT-In / Data Protection Board of India, when notified) within the timelines prescribed under applicable law (currently 6 hours for CERT-In reporting).
Notwithstanding our best efforts, no method of data transmission over the internet is 100% secure. Users are advised to protect their login credentials and log out after each session, particularly on shared devices.
8. COOKIES AND TRACKING TECHNOLOGIES
8.1 Types of Cookies Used
- Strictly Necessary Cookies: Required for the Platform to function (e.g., session management, authentication). These cannot be disabled.
- Analytics Cookies: Used to collect anonymised data on how users interact with the Platform (e.g., pages visited, session duration). We use [INSERT ANALYTICS TOOL, e.g., Google Analytics with IP anonymisation enabled].
- Preference Cookies: Store user settings such as language or display preferences.
8.2 Your Cookie Choices
You may manage, disable, or delete cookies through your browser settings. Please note that disabling strictly necessary cookies may impair the Platform’s functionality. A cookie consent banner is displayed on your first visit, allowing you to accept or decline non-essential cookies.
8.3 Do Not Track
The Platform currently does not respond to browser Do Not Track (DNT) signals. Users who wish to limit tracking should configure their browser settings or use opt-out tools provided by our analytics partners.
9. THIRD-PARTY LINKS
The Platform may contain links to external websites, resources, or third-party services. These links are provided for information and convenience only. The Company has no control over, and accepts no responsibility for, the content, privacy practices, or data security of such third-party sites. Users should review the privacy policies of any linked sites before providing personal data.
10. YOUR RIGHTS AS A DATA PRINCIPAL
As a user (“Data Principal” under the DPDP Act, 2023) and as a data subject under the SPDI Rules, 2011, you have the following rights, which may be exercised by contacting our Grievance Officer:
- Right to Access: Request confirmation of whether we process your data and obtain a copy of the personal data we hold about you.
- Right to Correction: Request correction of inaccurate, incomplete, or outdated personal data.
- Right to Erasure / Withdrawal of Consent: Request deletion of your personal data where it is no longer necessary for the original purpose, or where you withdraw consent, subject to applicable legal retention obligations.
- Right to Grievance Redressal: Lodge a complaint with our Grievance Officer (see Section 12). If unresolved, you may approach the Data Protection Board of India (once constituted under the DPDP Act).
- Right to Nominate: Under the DPDP Act, nominate another individual to exercise rights on your behalf in the event of death or incapacity.
- Right to Opt Out of Marketing: Unsubscribe from newsletters and marketing communications at any time by clicking “Unsubscribe” in any email or writing to privacy@knowledgehorizonindia.com.
We will respond to verifiable requests within 30 days. In complex cases, we may extend this period by a further 30 days with notice. We reserve the right to verify your identity before processing a request.
11. CHILDREN’S PRIVACY
The Platform is not directed at children under the age of 18. We do not knowingly collect personal data from minors. Under the DPDP Act, 2023, the Company will obtain verifiable consent from the child’s parent or lawful guardian prior to processing the child’s data. If we become aware that a child’s personal data has been collected without such consent, we will promptly delete it. Users may also contact the Grievance Officer at the details above to exercise their rights under Section 10. All grievances should include the user’s registered email address and a clear description of the concern.
13. INTELLECTUAL PROPERTY RIGHTS
All content published on the Platform, including but not limited to text, graphics, logos, images, course materials, data compilations, and software code (collectively, “Content”), constitutes the intellectual property of Knowledge Horizon India or its licensors, and is protected under:
- The Copyright Act, 1957 (as amended);
- The Trade Marks Act, 1999;
- The Information Technology Act, 2000; and
- All other applicable Indian and international intellectual property laws.
Users are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Content solely for personal, non-commercial educational purposes. Users must not reproduce, redistribute, publicly display, create derivative works, scrape, reverse-engineer, or commercially exploit any Content without the prior written consent of the Company. Any unauthorised use will constitute an infringement of the Company’s intellectual property rights and may result in civil and criminal liability.
If you believe any content on the Platform infringes your intellectual property rights, please submit a written notice to admin@knowledgehorizonindia.com with details of the claimed infringement, your contact information, and a declaration of good faith belief that the use is not authorised by the rights holder.
14. CHANGES TO THIS PRIVACY POLICY
The Company reserves the right to amend this Policy at any time to reflect changes in law, our data practices, or services. Material changes will be communicated to registered users via email and/or a prominent notice on the Platform at least 15 days before they come into effect. The revised Policy will be posted with an updated “Last Revised” date. Continued use of the Platform after the effective date of any amendment constitutes acceptance of the revised Policy. Users who do not agree with the revised Policy should discontinue use and may request deletion of their account.
15. GOVERNING LAW AND JURISDICTION
This Privacy Policy and all disputes arising out of or in connection with it shall be governed by and construed in accordance with the laws of India. The courts of Pune, Maharashtra] shall have exclusive jurisdiction to settle any disputes arising out of or in connection with this Policy, subject to any statutory overriding provisions.
